Privatization


Intra provides legal expertise in privatization transactions and in the analysis of disputes arising from the privatization of enterprises for the purposes of making amendments to privatization documents. Intra is also engaged in the representation of clients and protection of their interests before courts of general jurisdiction, commercial courts, arbitral tribunals and state bodies in all issues related to privatization.

Representation in commercial court of a client's interests related to a claim against the State Property Fund of the Krasnodar District for compensation of harm caused by the decision of the Fund, taken in violation of the privatization plan, aimed at the suspension of the sale of shares of an open joint stock company, as well as for the compulsory sale of shares;

Representation and protection of a client's interests before commercial courts and bodies of state authority on matters related to lawfulness of a cancellation of state enterprise privatization by means of passing the respective resolution of the Committee for the Management of Property; legal consequences of passing such a resolution; legal destiny of transactions for the sale and purchase of shares of a privatized enterprise in case of compulsory cancellation of privatization;

Representation and protection of the interests of a foreign investor possessing a share holding of a number of enterprises producing military goods and privatized in 1993. The legality of privatization had been contested in commercial court by the Office of the Public Prosecutor on the basis of rules contained in the State Program for Privatization of 1994. In its judgement the court gave retroactive effect to the legal norms, contradicting the basic principles of civil legislation.
