Immovable property. Protection of property rights
Intra provides analysis of the legal status of immovable property, determines the types and extent of rights in existence with respect to immovables, assesses perspectives of bringing immovables into commerce, assists in concluding and performing transactions related to immovables (purchase and sale, lease, etc), and represents clients and protects their interests before courts of general jurisdiction and arbitration courts in disputes related to immovables.
Representation in commercial courts, including the Supreme Arbitration Court, of the interests of a client responding to an action concerning the invalidation of a contract of pledge of a building. An action was founded on the fact that the contract of pledge of a building was not accompanied by a mortgage of the land parcel on which the building was situated, contrary to the provisions of Article 340 of the Civil Code of the Russian Federation. The court refused to satisfy the claim on the ground that the pledge of a land parcel is only possible where the pledgor is an owner or a lessee of the connected land parcel. In all cases where the pledgor of a building is not an owner or a lessee of the land parcel where it is situated, a mortgage contract may not be regarded as invalid on the basis of Article 340 (3) of the Civil Code. This judgement inspired paragraph 45 of the Joint Decree of the Plenum of the Supreme Court of the Russian Federation and the Plenum of the Supreme Arbitration Court of the Russian Federation No 6/8 of July 1, 1996 "On certain issues related to the application of Part I of the Civil Code of the Russian Federation".
Representation of the interests of an enterprise subject to bankruptcy proceedings that related to the rights of this enterprise on a building which was previously transferred to one of its creditors on the basis of a bailiff's order (as a result of a failed public auction). The right of ownership of the building had been registered by the creditor following the judgement declaring the initiation of bankruptcy proceedings with respect to the enterprise. An act by which the right of ownership to a building had been registered with a creditor had been invalidated by a judgement of a court.
Representation of the interests of a client relating to compensation payments to the owner of an immovable object situated on the territory of a reformatory institution.
